DATA TRANSFER YOU ACCEPT ALL THE TERMS AND CONDITIONS
OF THIS END-USER LICENCE AGREEMENT (E.U.L.A.). Using
this product is inferring CONSENT TO AGREE WITH
THIS EULA. If you do not agree with the terms and
conditions of this End-User License Agreement, delete
this product immediately.
Permitted Number of Computers: 2 Computer License
This file set contains software. The term "Software"
shall also include any upgrades, modified versions,
and copies of the Software Licensed to you by ISDS.
ISDS (Inner Sphere Design Studios, Inc) grants to
you a non-exclusive License to use the Software
and Documentation, provided that you agree to the
following:
Use of the Software
You may:
Install the Software in a single location on a hard
disk or other storage device on 1 computer. You
may also install the software at a second location,
providing you access the software with the same
credentials at both locations.
Copyright; Limited License
The Software is owned by ISDS (Inner Sphere Design
Studios). The Software is also protected by the
US Copyright. You may not copy the Software or the
Documentation, except as set forth in the "Use of
the Software" section. Any copies that you are permitted
to make pursuant to this Agreement must contain
the same copyright and other proprietary notices
that appear on or in the Software. You agree not
to modify, adapt, translate, reverse engineer, decompile,
disassemble or otherwise attempt to discover the
source code of the Software. Trademarks shall be
used in accordance with accepted trademark practice,
including identification of trademark owner's name.
Trademarks can only be used to identify printed
output produced by the Software. The use of any
trademark as herein authorized does not give you
any rights of ownership in that trademark. Except
as stated above, this Agreement does not grant you
any rights to intellectual property rights in the
Software. You agree not to access this program from
more then two Computers.
Transfer of License
You may not rent, lease, sublicense, transfer or
lend the Software or Documentation.
DISCLAIMER OF WARRANTY:
ISDS, Inc. disclaims all warranties, either express
or implied, including but not limited to the implied
warranties of merchantability and fitness for a
particular purpose. This means that if you download
software concerning this game, you agree that ISDS,
Inc. has no liability for any damages that you incur
when using it, whether or not those damages are
caused by a problem with the software, and whether
or not you have brought such problems to ISDS's
attention. ISDS is also not responsible in any way
for any software you purchase or use in conjunction
with playing ISW.
Financial Liability and agreement concerning rendered
payments
You agree not to hold ISDS financially liable in
any way as a result of program conflicts, server
availability or other software or game play related
issues. You agree to abide by the published and
available Rules of Conduct (ROC). You agree that
if you are dismissed from ISW due to a violation
of the ROC that you are NOT entitled to either a
partial or full refund of any funds rendered for
that pay period. You agree that any funds you do
pay to ISDS in order to be considered a full player
of ISW are non refundable after 50% of the billing
period has elapsed. Before that time Refunds will
be prorated not to exceed 50% of the total amount.
ISDS reserves the right to specify form of payment
for refunded monies.
Rules of Conduct (ROC)
ISW Players are subject to expulsion any of the
following actions.
1. Continued online use of profanity or race related
insults.
2. Use of Hacked Mech Warrior IV files.
3. Use of any third party software designed to give
an unfair advantage to the player using it. Examples
are Net Hack, Speed Hack, Mech Trainer, Aimbot,
OGC, etc…..
4. Using Multiple Accounts to spy on adversaries
or other players.
5. Refusal to obey COMSTAR directives or orders.
6. Violation of any part of this EULA.
General Articles
I. You hereby waive all rights to sue or take any
other legal action against ISDS, its affiliates
or sponsors.
II. You hereby agree and acknowledge that all ISW
software is protected by Copyright laws and is NOT
public domain, but is the private property of ISDS.
You also agree that should you attempt to modify,
adapt, translate, reverse engineer, decompile, disassemble
or otherwise attempt to discover the source code
of the Software you will be terminated immediately
without refund from the ISW player base. You also
agree that you fully understand the above statement
as it applies to legal justification for prosecution.
In Laymens terms, if you are caught you are confessing
to the copyright violation right here.
Governing Law and Jurisdiction
This Agreement will be governed by the statutes
and laws of the State of Nevada and the United States
of America. If any part of this Agreement is found
void and unenforceable, it will not affect the validity
of the balance of the Agreement, which shall remain
valid and enforceable according to its terms. You
agree that the Software will not be shipped, transferred
or exported into any country or used in any manner
prohibited by any applicable export laws, restrictions
or regulations. This Agreement shall automatically
terminate upon failure by you to comply with its
terms. This Agreement may only be modified in writing
signed by an authorized officer of ISDS. Unpublished-rights
reserved under the copyright laws of the United
States of America.
Note - The Term “ISDS” implies all officers, affiliates
and partners of Inner Sphere Design Studios, Incorporated
– A Nevada Based Corporation
